Pokémon cards meet the requirement of a game element and when purchasing a Booster Pack, money is wagered by the buyer. In addition, when opening a Booster Pack, there is the chance to receive a rare (read expensive) Pokémon card or not. The chance of getting a rare card is based on chance.
It is true that Pokémon cards fall under the Gambling Act, but card and companion games such as Pokémon, Magic! and Yu-Gi-Oh made an exception. The reason for this is that the buyer of Pokémon Booster Packs, for example, always receives cards, even though they are cards that he may not want.
Perhaps there will be other laws and regulations regarding trading card games in the future. For the time being, Pokémon cards are not considered gambling.
